---------

IN THE LABOUR COURT OF ZIMBABWE HARARE 10 NOVEMBER 2023

JUDGMENTNO LC/H/149/24 CASE NO LC/H/146/23

AND 3 APRIL 2024

OSCAR SITHOLE	APPLICANT

GEORGE PADULE	1ST RESPONDENT AND

NANYI MINERAL RESOURCES (PVT) LTD	2ND RESPONDENT

BEFORE THE HONOURABLE CHIVIZHE, JUDGE:

For Applicant	Mr S. Mwandiwanza (Legal Practitioner)

For Respondent	In Default

CORRIGENDUM

CHIVIZHE, J;

Please take note that the order handed down on the 10th of November, 2023 under reference LC/H/ORD/878/23 carries the following errors and omissions;

The Applicant was not in default but rather the Respondent was the one who was in default therefore the representative for the Applicant shall be amended from “in default” to “Mr S. Mwandiwanza.” (Legal Practitioner)

The legal practitioner’s name who appeared for the Applicant on 1 November (the date of the hearing) was misspelt as “Mr.S Mwandiwanzira” it is corrected to read as ‘Mr.S.Mwandiwanza’.

The draft order was also amended in chambers on 1 November 2023 upon an oral application by the legal practitioner for the Applicant, Mr Mandiwanza which application was duly granted, point number 3 was consequently inserted into the order which reads as follows;

“3. If the parties fail to agree on the quantum of damages in lieu of reinstatement, the Applicant shall apply to this court for the quantification of damages.”

Point number 3 on the draft order which reads, “The 2nd Respondent shall pay the costs of suit” therefore became point number 4.

The Order is accordingly amended to that effect.

Chikore and Chigwaza, Applicant’s legal practitioners
